When A Relative Dies...

If you have had a death in the family and the decedent lived in and owned immovable (house, lot, building) property in Louisiana, you will need to hire an attorney in Louisiana to open the succession in Louisiana to get a judgment of possession rendered by the court in order for the property to be transferred to the new owner. In Louisiana, a party has nine months from the date of death to file the succession without incurring any penalties. Depending upon the monetary amount involved in the succession and the number of heirs, no tax may be due regardless of the time period.

The attorney's fee cost for the succession is not based on the value of the estate, and is based on the complexity of the succession. Remember, Louisiana law is different from the rest of the country, and you will need a Louisiana attorney for a Louisiana succession.
